Paul Krugman Battles 'Beltway Deficit Feedback Loop,' And Not By Himself 2FEB13

AS I said before, Pres Obama wold have done well to nominate Paul Krugman as his Sec of Treasury, it his kind of thinking and independence from the monied interest that control Washington that would provide the leadership to guide us out of this recession. Unfortunately is it doubtful Mr Krugman would have been approved as Treasury Secretary. Look at what Chuck Hagel is going through just because he is speaking the truth, imagine what the Senate would do to Paul Krugman. Still, this is an important piece, and reinforces what the American people already know, we have to fix our economy and get out of the recession before dealing with our national debt. Paul Krugman Deficit Hawks

Paul Krugman is no stranger to going on teevee and encountering, well, people of an addled aspect -- he's done "Squawk Box", after all! But there was something very special about one of his most recent appearances on MSNBC. You thought that Felix Baumgartner dude who fell to earth for Red Bull was extreme? Take a seat, balloon boy. Paul Krugman has become the first human I've ever witnessed escaping from the gravitational pull of something with black hole-like density: Joe Scarborough and his gang of deficit hacks.
Krugman has this interesting thesis about the way "thinking" congeals among media elites. He thinks that they are overly obsessed with a deficit crisis that is decades from happening, if it happens at all. He observes that in this time of widespread unemployment and grievous economic dislocation -- a continuing condition of the lightly tended to 2008 economic calamity -- and against all evidence, the media elites have become convinced that the long-term budget deficit is the actual crisis that's emerged in America, to claim its future. And then you get a cycle -- blather, wince, repeat -- in which all of these cosseted simps reinforce one another until this bizarre line of thinking is deeply entrenched and inalterable.
It's an old yarn, and Krugman's far from the first person to notice. Greg Sargent calls it the "Beltway Deficit Feedback Loop," and as the National Journal reported back in May of 2011, it's been unfolding within the media and distorting its coverage -- mostly to the expense of the more serious unemployment crisis. (There is no comparable feedback loop on the unemployment crisis. Aside from occasionally speculating on how high unemployment rates could affect the electoral hopes of prominent political celebrities seeking re-election, it's almost never discussed.)
But, as with any theory, it's always great to observe the Feedback Loop in nature, and that's what Krugman's journey to MSNBC's blasé kaffeeklatsch successfully revealed -- proof of this thesis.
The best part of the exchange comes after Ed Rendell attempts to invoke the talismanic power of the Simpson-Bowles Commission, which media elites believe is somehow magical, (and more often than not evince no awareness of what the Simpson-Bowles plan called for) but is better known as one of the links in a long-running failure chain that eventually resulted in our current regime of continual, self-engineered fiscal crises.
KRUGMAN: So two guys can write a report that calls for all kinds of good stuff and they can’t even get their own commission to agree on the report. And you’re saying this should be our policy? We need to focus on what is urgent right now, which is creating jobs and getting this economy back to full employment.
RENDELL: But the way you do that is to build a political coalition to do something about the long-term debt.
KRUGMAN: Have you been living in the same country as I have these past five years?
SCARBOROUGH: My message is, we’ve got a coming collapse if we don’t take care of our entitlements.
KRUGMAN: It’s a long way off, it’s not necessarily even true.
What follows from there is a strained comparison between the deficit and climate change, and some concern trolling over the S&P downgrade, which affected the U.S. bond market nary a whit. Eventually Richard Haass levels this strange accusation at Krugman, "You’re basically willing take enormous risks with the American economy."
KRUGMAN: People like me have been saying for five years, don’t worry about these deficit things for the time being, they’re a non-issue. Other people have been saying, ‘Imminent crisis, imminent crisis!’ How many times do they have to be wrong and do people like me have to be right before people start to believe this?
HAASS: You’re right until the day you’re wrong, and that’s a bad day.
If pure bafflegab could power manned space flight vehicles, we'd be establishing the first colony on Mars this very week. The notion that the guy urging the mitigation of the unemployment crisis is the one taking enormous risks with the economy is simply astonishing. "You're right until the day you're wrong and that's a bad day," isn't even an argument. You could say the same thing to the gravitational constant, if it were a living thing that could walk onto a teevee set and get ridiculed by pedants. I'm quite sure that Nate Silver remembers the time that the Morning Joe crew predicted he'd be on the business end of a similar comeuppance.
Haass' position, that not fixing the debt will precipitate some epic crisis, is also way overstated. It's plausible that we could see rising interest rates or inflation at some point. And that would be bad for the economy (though the Federal Reserve could treat these conditions), it's not necessarily going to set off some sort of global run on the dollar or a big financial crash. Of course, even if we did, its major adverse effect on the real world would be mass unemployment, which we're facing right now. So what Haass is actually saying is that we cannot afford to fix the massive unemployment crisis now, because it could result in some future massive unemployment crisis. That's a decidedly oddball position to take.
But the most purely risible thing that was uttered was Ed Rendell's contention that the way you solve the unemployment problem is by first "building a political coalition to do something about the long-term debt." The need to do something about the long-term debt is a matter of concern, but it's not nearly as urgent as the unemployment crisis. What's more, this is wrong way to link these two concerns -- Rendell's prescription is the equivalent of a captain of a capsizing luxury liner calling for immediate swimming lessons on the Lido Deck.
But beyond that, if the current economic emergencies can only be solved by building a political coalition around solving the long-term budget trajectory, then that is basically like saying that there will be no relief for our current economic emergency, because if there's one thing Washington has not been able to do since the financial crisis is form any sort of coalition around the debt.
We've tracked this: the efforts began with a Senate Deficit Commission (which died after its GOP co-sponsores bailed), to President Barack Obama creating the Simpson-Bowles Commission (which failed to form a coalition), to the Super Committee (which failed in similar fashion), to the current budget sequester (which would make steep cuts in spending, but not the ones the fiscal hacks want). We've been trying to form this magical political coalition for years and the efforts have only made things worse.
The problem of long-term health care costs are real. The concerns that Medicare and Medicaid need significant attention to remain robust programs are not mislaid. But making steep cuts to those earned benefit programs don't actually fix health care costs, they merely get the government off the hook for health care spending, and put the pressure on the private sector (creating a drag on growth) or individuals (creating impoverishment and death). This tactic absolutely will reduce government spending, in the same way that you can reduce spending right now by not paying your rent.
It's time to table the notion that long-term deficits are cause for immediate alarm. The fact of the matter is that interest rates are low, U.S. Treasurys are strong, there's no reason why we can't spend productively, put people back to work, solve the crisis of aggregate demand that's crippling growth, and arrest the deepening hysteresisthat's threatening our fragile recovery.
Moreover, we should probably take a break from all the breathless blather about impending bond meltdowns or America turning into the next Greece. As Neil Irwin points out, these fears stem from the weird crisis mythologizing of the pundit class, against the evidence in which economists are steeped:
A persistent fear is that investors will at some point decide that the U.S. government’s finances are a mess and/or inflation is at risk of getting out of control, and shun U.S. treasury bonds. This could cause a spike in interest rates and, for the Treasury, trouble rolling over the debt. The thing is, there is not even a shadow of a hint of this risk priced into financial markets. Treasury borrowing costs are extraordinarily low, as are market expectations of inflation. In traditional economic models, inflation can only really take hold if and when the economy is getting back close to its full economic capacity -- and if that happens, it would also mean a rapidly falling budget deficit.
That last point is key, because the good news is that solving the unemployment crisis first is the proper way of arranging the cart and the horse. Over at Business Insider, Joe Wiesenthal presents the case for fixing the debt by first solving the unemployment crisis pretty effectively, noting that the "primary driver of deficits is a lack of growth"and getting people back to work would provide that growth, new revenues, and deficit reduction. And he points out that there is an observable 60-year trend in which deficits rise and fall according to the civilian employment rate:
deficits and unemployment
Wiesenthal's meticulous argument deserves to be read in full, so go do that. I'll simply note here that he goes on to lay out how 'over the last few years, the deficit as a percent of GDP has been falling at its fastest pace since WWII, all thanks to people re-entering the workforce, and the pain of the economy being reduced," which means we're accomplishing something to shore up the deficit right now, and doing so without the European-style "belt-tightening" which is driving nations like the United Kingdom into deeper and deeper economic misery. He also has great advice to anyone who wants to take up this argument and drive it home like a boss:
In the debate over fiscal policy, you frequently hear liberals argue: "It's not time to deal with the deficit, we need to fix the economy first and then fix the deficit when the economy is stronger." While this has merit as a political concept, it's actually giving into a false frame that dealing with the deficit and dealing with unemployment are two separate things that you do at different times. Steps you take to improve unemployment are deficit reduction measures ... While the government has done, technically, nothing to address the deficit in the last few years, the deficit is shrinking (relative to GDP) merely because the economy has improved, and more people are going back to work. If unemployment drops to 7 percent, or 6.5 percent, or 6 percent, we'll get quite a bit of deficit reduction then.
None of this is some sort of otherworldly, out-of-the-mainstream thinking, and it dovetails pretty neatly with what Krugman has been arguing for years. But the deadweight Washington consensus on junk economics is powerful. Scarborough, after subjecting Krugman to a thorough helping of debt hack tautologies on his show, went back for a second helping in a slapdash Politico column (another feature of deficit hackery is the constant need to repeat the same arguments, as if they aren't getting a sufficient hearing), in which he reiterates that all the evidence he needs to support the claim is just the fact that he talks to a lot of people who agree with him, and that, in addition, he's been making the same claims over and over again, so -- ipso facto -- they must be true.
It's not clear that Scarborough is paying close attention to what Krugman was actually saying on his show, because right up at the top of his piece, he hilariously misrepresents Krugman's basic position, claiming that that Krugman believes "Americans would be better off if its government ran deeper deficits and ignored its longterm debt." Actually, Krugman said, right to Scarborough's face, "Give me something that looks like a normal employment situation and I'll become a deficit hawk."
There is further nonsense about Krugman taking a firm on ignoring "Medicare and Medicaid shortfalls," but he similarly said no such thing: "Yeah, there is [a long structural problem with Medicare and Medicaid]," Krugman says, "but you've got to ask, why is it urgent that we address that problem right now." He then went on to suggest that in the short-term, there are many ways to reduce health care costs so that the future isn't so bleak. None of this is "ignoring," it's simply about setting priorities, and -- once again -- favoring the amelioration of the unemployment crisis right away. (Scarborough himself framed the "structural Medicare" problem as something that was 20 years out, so why Krugman is suddenly not allowed to play by the same rules in his response is just an example of Beltway pundit Calvinball.)
But the most ignorant claim Scarborough makes is the one embedded in his headline, "Paul Krugman vs. the world," which advances the thesis that Krugman is all on his lonesome, with an off-planet explanation of how the economy works.
It's simply not true! For example, here's the decidedly non-obscure Alan Blinder, making the same argument, perhaps even more pointedly than Krugman. To his estimation, the proper way to solve the deficit problem is to tackle it in "three parts ... one for right now, one for the next decade, and the last for the very long run:"
RIGHT NOW: With the economy still so weak, the case for near-term fiscal contraction is weak as well. We shouldn't kick away the fiscal crutch until the patient is ready to walk. If I am allowed to indulge in wishful thinking, a two-pronged policy that combines modest fiscal stimulus up front with serious deficit reduction thereafter would be even better.
THE NEXT DECADE: Strange as it may seem with trillion-dollar-plus deficits for four years running, the U.S. government still has no short-run borrowing problem. On the contrary, investors all over the world are still clambering to lend us money at negative real interest rates. In purchasing power terms, they are willing -- nay, eager -- to pay our government to borrow from them!
According to Congressional Budget Office January 2012 projections, the federal deficit as a share of GDP will shrink from 9 percent of GDP in fiscal 2011 to roughly 5 percent of GDP in fiscal years 2015-2018, without any further policy actions. To be sure, 5 percent of GDP is still too high. But coming from the stunning 10 percent of GDP in 2009, it's a long way down. A reasonable target for deficit reduction over the next decade might be 2 percent to 3 percent of GDP, starting perhaps in fiscal 2014.
THE VERY LONG RUN: The truly horrendous budget problems come in the 2020s, 2030s, and beyond. But while the long-run budget problem is vastly larger, it is also far simpler, for two reasons. The first is that the projected deficits are so huge that filling most of the hole with higher revenue is simply out of the question. Spending cuts must bear most of the burden. The second is that there is only one overwhelmingly important factor pushing federal spending up and up and up: rising health care costs.
That's just one of the many people who echo the same remedy as Krugman. In a separate post, the aforementioned Wiesenthal collects a roster of similar-minded people, who range from liberal to conservative and economist to policymaker. That's important to note: this is not an issue of right-versus-left ideological conflicts. This is a right-versus-wrong conflict, pure and simple. It's a Beltway bubble versus real-world conflict. It's a data-tested versus magical-thinking conflict.
The good news is that the American people haven't bought into the nonsense, and inpoll after poll favor solving the more pressing unemployment crisis over fixing the long-term budget trajectory. And even those who want action taken on the deficit do not favor major cuts to earned benefit programs like Social Security or Medicare. (Social Security, which can be provided with greater solvency simply by loosening or discarding the current income caps on contributions, needn't even be part of the larger long-term deficit discussion.)
These are understandable positions for anyone who actually knows an unemployed person, or who lives through the grind of our demand crisis on a daily basis, but media elites don't know or desire "access" to unemployed people and can't appreciate the day-to-day problems that millions of Americans face in getting their households through another week of survival. According to a new report from the Corporation for Enterprise Development, "almost half (43.9%) of U.S. households are living on the edge of financial collapse with almost no savings to fall back on in the event of a job loss, health crisis or other income-depleting emergency." This is not a populace that can currently power economic growth on its own, and until its members get help, deficits will persist. Further cuts in the short-term that extract further wealth from the economy will only deepen the risks that millions of Americans face.
It's popular to say things like, "Well, if we don't figure out how to right-size the budget, what are we going to do in 20 years when the next Hurricane Sandy hits?" Well, remember, we're still dealing with the first Hurricane Sandy, and our faltering efforts to bring relief to those affected has been hopelessly scrambled by the inane Beltway Deficit Feedback Loop. We just came very close -- too close! -- to simply not providing any Hurricane relief at all. At the very least, what would normally be an easy call became much more complicated as we debated whether we could authorize relief money.
I guess the thinking was, "Hey, it's too bad you are freezing to death in the Rockaways right now, but maybe you can comfort yourselves in the knowledge that the FY 2025 budget trajectory will be incrementally better!" That's the actual weirdo thinking in this debate. It's destructive and embarrassing, and the favor bestowed on the goofy little clique that espouses it, forsaking all logic, is a continual bafflement.

Gabby Giffords' hearing today interrupted with news of mass shooting in Phoenix 30JAN13

GABBY GIFFORDS' testimony before members of the US Senate on gun violence and gun control was interrupted with the news of more gun violence, another mass shooting in Arizona. From Daily Kos.....

This morning former Arizona Congresswoman Gabby Giffords and her husband Mark Kelley were among the witnesses at a Senate Judiciary Committee investigating gun violence and gun safety. During Mr. Kelley's presentation, he interrupted one of his answers to say that a mass shooting had just been reported in his home state of Arizona.
What we know at this point is that a white male in his 60s walked into a large business building in north central Phoenix, got into an argument in the lobby, and started shooting—at least 10 shots were fired and two different guns were used. The suspect fled and has not been captured. Six people were injured, three were shot seriously and taken to John C. Lincoln Hospital. The TV's are filled with coverage right now, and SWAT officers have surrounded a nearby home, possibly the shooter's residence. That's all we know right now.
Police have confirmed that three people were shot at a business complex near 16th Street and Glendale Avenue in Phoenix Wednesday morning.
Phoenix police spokesman Sgt. Tommy Thompson said there was an altercation prior to the shooting inside the building at about 10:30 a.m. He said police do not believe this was a random shooting. azfamily.com
It appears to be a job-related incident, and the office building has been cleared. Helicopter news cameras are showing the SWAT officers surrounding the home and they seem prepared to enter. Reporters are now saying they have the suspect's name. Neighbors say he's a really nice guy.
Arizona is an open-carry state, where anyone can carry a holstered weapon—no registration or permit required. Just about anyone can buy anything at gun shows, no questions asked. So it's not unusual to see people walking around the grocery story with a pistol strapped to their hip. It's stuff like today's shooting, in the wake of Newtown, that's making people very edgy. A fellow walked into a K-Mart just last week with a weapon, and people went fleeing for the exits.
To quote Gabby, "Enough."
UPDATE: Sadly, one of the victims has died. This link has much more new information:
The suspect in the deadly Wednesday morning Phoenix office building shooting has been identified as Arthur Douglas Harmon, 70, according to 12 News sources. Arizona Republic

MAKING WAVES! Walmart: End factory deathtraps in Bangladesh
Background:Fire aftermath  In November, a fire tore through the Tazreen garment factory, a Walmart supplier in Bangladesh. Emergency exits were locked from the outside, and managers told workers to return to their sewing machines as smoke filled the factory. 112 workers were killed. Weeks later, the New York Times revealed that Walmart executives had been aware of the dangers in their Bangladeshi factories, but had blocked a program to improve fire safety.
Partners: The International Labor Right Forum, United Students Against Sweatshops, Corporate Action Network, Change To Win, and Jobs with Justice.
What we want: We want Walmart to sign onto the Bangladeshi Fire Safety Agreement, an independently monitored program which requires global retailers to provide funds for improved fire safety in their Bangladeshi suppliers.
Current status: Over 110,000 of us signed a petition calling on Walmart to strengthen fire safety in the factories it buys from worldwide, and we delivered the petition during a rally at Walmart's lobbying headquarters. Walmart has claimed that it toughened rules governing its Bangladeshi suppliers, but these reforms are meaningless without independent monitoring funding for basic safety measures. So now we're raising the stakes by collectively donating $20,000 to bring both a Bangladeshi labor activist, and a survivor of the deadly Tazreen factory fire to confront Walmart executives.

VICTORY! No child labor at Whole Foods
Whole FoodsBackground: Whole Foods, America’s largest organic retailer, likes to brag about its efforts to popularize fair trade goods. But Whole Foods shelves were partially stocked with cheap chocolate produced by forced child labor.
Partners: The Teamsters and the International Labor Rights Forum
What we want: We wanted Whole Foods to commit to only selling certified fair trade chocolate, since only independent supply chain certification can guarantee that chocolate is free of child slavery, which runs rampant in the cocoa industry. Additionally, we wanted Whole Foods to stop doing business with companies that continue to profit from child slavery in the chocolate industry.
Current status: Whole Foods agreed to create a certification process to help chocolate producers monitor and control their supply chain.Whole Foods will challenge suppliers to improve working conditions in their fields, by creating quality-based ratings system. This system will help encourage any companies that sell to Whole Foods to remove child labor from their supply chains.

VICTORY! FCC: Regulate prison phone rates
Prison PhonesBackground: A small handful of telecom companies with monopoly contracts can impose exorbitant phone costs -- upwards of $1 a minute -- on prisoners and their families. Most states do not regulate rates, since they frequently receive kickbacks from highly profitable phone operators. These rates exploit vulnerable people, including the 2.7 million children with an incarcerated parent, and, by cutting them off from their families, increase the rate convicts will commit another crime upon release.
Partners: The Prison Policy Institute and the Center for Media Justice
What we want: We want the Federal Communications Commission (FCC) to protect incarcerated people and their families from exploitation by regulating interstate phone call rates.
Current status: After circulating the petition to our list, we received over 36,000 signatures and more than 2,000 original comments to the FCC. On the day we delivered the comments, the FCC announced that it would be issuing new rules to lower long distance rates for prisoners.

MARKED PROGRESS! Pepsi: Speak out against the Uganda Kill the Gays bill
Background:Uganda protest Ugandan legislators are considering legislation that would institute the death penalty for gays and lesbians, and allies in Uganda felt that if multinational companies spoke out publicly against the bill, it would sway Members of Parliament (MPs) on the fence to vote against it. Pepsi has a history of supporting equality and has a massive presence in Uganda.
Partners: Ugandan Civil Society Coalition on Human Rights and Constitutional Law and Health GAP
What we want: We asked Pepsi to publicly oppose the bill and communicate its opposition to MPs in the Ugandan Parliament.
Current status: Over 116,000 signatures were delivered to Pepsi HQ in December, and, we took out an ad in Advertising Age, an industry publication, to get Pepsi's attention. Just this week, Pepsi's VP of Global Policy and Government Affairs met with Kaytee, our Campaign Manager. He heard our concerns, and agreed to continue watching the situation closely, and ensure Pepsi uses its voice effectively to stop passage of the bill. To that end, we are putting Pepsi executives in touch with LGBTI groups in Uganda so they can coordinate opposition on the ground.
As far as the bill itself, thankfully it did not pass before the Ugandan Parliament disbanded for Christmas. But allies in Uganda warn that there is a good chance the bill will be considered when Parliament reconvenes next week, so we will stay in touch with allies in Uganda and make sure Pepsi keeps its word to help stop this horrible law.

MASSIVE ACTION! Walmart: Stop selling assault weapons
Background:Walmart guns Walmart is the largest gun retailer in the country, and sells assault rifles -- including the AR-15 used in the Sandy Hook shooting -- at hundreds of its stores across the US. In the wake of the tragic shooting of 20 children in Newtown, CT, Americans joined together to fight against easy access to assault rifles.
Partners: Courage Campaign, MomsRising.org, Change.org
What we want: We demanded that Walmart stop selling military-grade assault rifles, like those used in recent mass shootings, entirely.
Current status: Nearly 300,000 people, including 115,000 SumOfUs.org members, signed the petitions to Walmart. 60 people delivered those signatures, along with a letter from 75 survivors of mass shootings, at the Walmart just down the road from Sandy Hook Elementary one month after the tragic shooting. The petition delivery was covered in over one thousand media outlets, including USA Today, CNN and Bloomberg. Walmart released a statement that it respected its customers and would follow the law -- a pointless statement that shows we need to keep the pressure on Walmart until these guns are no longer on the shelves next to baby food and school clothes.

VICTORY! Pfizer, leave the Heartland Institute!
Heartland's lossBackground: The Heartland Institute has long been a right-wing front group for corporate climate change apologists and tobacco companies looking to overturn against nicotine regulation. Early last year, the Heartland Institute unveiled its most outrageous campaign yet when it compared advocates of carbon regulation to terrorists and serial killers. Shortly after the backlash began, and thanks to the work of SumOfUs.org and Forecast the Facts, Heartland lost over half its funding, but Pfizer, a major donor, stubbornly remained.
Partner: Forecast the Facts, 350
What we want: We wanted Pfizer to join over twenty other groups in fleeing the Heartland Institute.
Current status: Victory! In November, Pfizer announced that it had decided not to renew its annual funding for the Heartland Institute, depriving the group of a major source of income. Thanks to your work, the Heartland Institute has been so defunded and demoralized that it was forced to cancel its annual climate denial conference.

AMAZING PROGRESS! Walmart: Respect your workers.
Backgrouwalmart protestnd: This autumn, Walmart workers across America took a huge risk and launched a series of strikes at the world's largest retailer -- the first in the chain's history. The campaign culminated on Black Friday, the biggest shopping day of the year. Hundreds of associates walked off the job to protest low wages, inconsistent scheduling, dangerous working conditions, and retaliation against workers who had asked for better treatment.
Partners: Warehouse Workers United, Warehouse Workers for Justice, OUR Walmart, and Making Change at Walmart
What we want: We want to help Walmart workers win the respect they deserve from management. We want to see Walmart end retaliation and sit down with workers to see how it can treat its employees fairly.
Current status: When Walmart workers went on strike, SumOfUs.org members around the world donated over $75,000 to support striking Walmart workers. It was our most successful fundraiser ever! In fact, we raised so much that the workers' organization, OUR Walmart was able to use some extra money to hire Walmart associates who had been working to improve working conditions as organizers, starting with Semetra Lee, of Richmond, CA. Semetra was a temporary worker who began working with OUR Walmart after experiencing bullying and racism at her position. She was written up, and her contract was not renewed due to her activity organizing her fellow workers.
Walmart is starting to feel the impact of these strikes. In January, Walmart committed to improving its scheduling system and implementing a monitoring program to improve conditions in its warehouses -- key victories for OUR Walmart and Warehouse Workers United members. Of course, these changes aren't enough -- for instance, the warehouse monitoring program is based on Walmart's disastrous global monitoring program, which allowed the Tazreen fire in Bangladesh to happen. So Walmart workers will keep fighting, and we'll be there to support them

Obama Recess Appointment Ruling Opens Pandora's Box Of Legal Challenges 2FEB13

TURNABOUT is fair play, and I hope the labor unions and workers rights organizations are reviewing NLRB decisions in favor of companies to have them overturned. This doesn't have to end up being a ruling benefiting corporate America. From HuffPost....

WASHINGTON -- The appeals court ruling striking down President Barack Obama's recess appointments to the federal labor board is barely a week old, but the business community is already using it to undermine decisions made by the board that had benefited unions.
In the ruling, known as Noel Canning v. National Labor Relations Board, a panel of three Republican-appointed judges declared that Obama had violated the Constitution last January when he appointed three members to the NLRB, the federal agency tasked with enforcing labor law on unions and employers.
If it stands, the sweeping decision by the U.S. Court of Appeals for the District of Columbia Circuit could call into question a long tradition of presidential recess appointments, and it could undo a year's worth of work by the labor board, as the invalidation of the appointees would mean the board didn't have a legitimate quorum to issue rulings.
In a sign of the legal maneuvering that may come, the U.S. Chamber of Commerce has filed a letter using the ruling to challenge significant new rules that the labor board put forth to streamline the union election process. The Chamber's letter is most notable because the new union election rules were not issued under the current board that was rocked by the appeals court decision last week.
Instead, the rules were issued in December 2011, when the board had a different makeup of members. Given last week's ruling, the Chamber argues, the March 2010 recess appointee to the board of Craig Becker was also illegitimate -- and without Becker, the board didn't have the appropriate quorum to issue the rules to begin with.
"[U]nder Noel Canning, there were only two properly sitting Board members when the rule was purportedly adopted on December 16, 2011," the Chamber lawyers write in the letter, dated Jan. 30.
The letter hints at the pandora's box that's been opened by last week's decision, as any competent lawyer will use it to question unfavorable decisions made under similar recess appointments. The Chamber has already issued guidance to its membersurging them to try to overturn union- and worker-friendly decisions that the labor board has issued over the past year. The board has ruled on more than 200 cases since Obama made the recess appointments.
"My sense is the business side is sort of licking its chops," said Wilma Liebman, a former labor board chair. "This decision, were it to be the final word, potentially has gigantic ramifications, and not just for the NLRB."
The sweeping nature of the appeals court decision would cast doubt on many of the recess appointments made to the labor board in recent decades, by presidents on both sides of the aisle. Finding it increasingly difficult to have board nominees confirmed by the Senate, presidents have relied on the recess appointment simply to keep the five-member board functioning, if not always at full capacity. By HuffPost's count, at least 23 recess appointments have been made to the board since 1988.
The union election rules were already tied up in litigation on appeal, making it easy to raise Noel as a pertinent issue. But, in theory at least, the ruling could even shake up cases that were thought to have been long settled.
"I'm being half facetious, but why limit it to the election rules?" said Fred Feinstein, a former general counsel for the labor board. "It's occurred to me they could go back forty or fifty years and try to declare cases invalid."
"All of this suggests that we're in uncharted waters here to some extent," Feinstein went on. "When you dig down, the implications of a decision like this are fairly chaotic. It's difficult to unscramble this egg."
Nancy Cleeland, a spokeswoman for the NLRB, wouldn't comment directly on the Chamber's letter, but she said the board itself is carrying on with business as usual in the wake of the ruling, which many expect to be taken up by the Supreme Court.
"As the board has already stated, this ruling applies only to one case," Cleeland said. "The board is continuing to move forward and issue decisions."
While the board has said it's merely trying to update antiquated labor law and eliminate red tape, the business lobby has assailed the new election rules as a gift to organized labor, claiming they'll lead to "quickie" union elections at workplaces. Business-friendly House Republicans, many of whom have assailed the labor board over the past two years, went so far as to pass legislation that would block the election rules from going into effect.
Michael Wasser, a policy analyst at American Rights at Work, a pro-union advocacy group, said the Chamber is using the recent court decision to try to block what he described as commonsense reforms to the union election process.
"This letter is the latest in a long line of tactics used by the Chamber and big business to undermine workers who try to gain a voice on the job," Wasser said. "The rule in question modernizes the union election process so both businesses and employees have the benefit of clear, consistent procedures, and workplaces are more productive because of it."
While the Chamber has advised companies to appeal unfavorable rulings, at least one company has already gone a step further. According to Reuters, hospital chain Prime Healthcare Services has told the Services Employee International Union that it simply won't comply with two board rulings: one that mandated the collection of union dues after a collective bargaining agreement has ended, and another forcing employers to turn certain materials over to unions during internal investigations.
According to Feinstein, the NLRB historically has a good record of handling cases expeditiously, to the benefit of both unions and employers. The possibility that cases may be upended -- or at least tied up in further litigation -- could disrupt the board's core mission, he said.
"This uncertainty of how the process will unfold at this point undermines the ability of agency to do what it's been successful at: getting the cases quickly and resolving them quickly," said Feinstein.

Sea Shepherd Needs Your Help To Save Whales & Help Captain Watson 29JAN13

HERE are the links for the We The People petitions started by Sea Shepherd and the reasons behind the petitions. More information on this is available at Sea Shepherd E-News: What you can do for the oceans 1FEB13 http://bucknacktssordidtawdryblog.blogspot.com/2013/02/sea-shepherd-e-news-what-you-can-do-for.html

Conservation Group Launches Two White House Petitions; Has 30 Days to Collect 100,000 Signatures
Sea Shepherd Conservation Society, the world’s leading direct-action conservation non-profit, today has filed two petitions on the White House  “We The People” page of the website which seek the U.S. Government’s support in upholding conservation law regarding protecting at-risk whales in the Antarctic’s Southern Ocean Whale Sanctuary and with ensuring safe haven for the organization’s respected founder, Captain Paul Watson.
The first petition is titled, “Take strong action to stop the Japanese from killing whales in the Southern Ocean Antarctic Whale Sanctuary” and can be found at:http://wh.gov/Vnbu. The full text of the petition language follows:
“The President must take swift and decisive action against Japan's illegal whaling.
Under the Pelly Amendment and the Packwood-Magnuson Amendment, the President has the power to apply economic sanctions against Japan for its continued whale slaughter in the Antarctic Whale Sanctuary. The United States asserts that it resolutely opposes whale hunting by Japan, but does little to actually bring a halt to the practice.
The U.S. State Dept. has declared: “We remain resolute in our opposition to commercial whaling, including so-called ‘scientific’ whaling, in particular in the Southern Ocean Whale Sanctuary established by the International Whaling Commission. In this context we wish to emphasize that lethal techniques are not required in modern whale conservation and management.”
The second petition is titled, “Provide Safe Haven to Captain Paul Watson, Founder of Sea Shepherd Conservation Society” and can be found at: http://wh.gov/VnRf. The full text of the petition language follows:
We request the U.S. not extradite U.S citizen Paul F. Watson.
There are two active Interpol Red Notices issued against Captain Watson at the request of Costa Rica and Japan. Underlying these notices are non-lethal acts in defense of marine life suffering from illegal shark fishing and whaling operations. The warrants are politically motivated.
Captain Watson is a world-renowned and highly respected leader in environmental issues. In 1999, he was awarded President George H.W. Bush’s "Daily Points of Light" Award and in 2000, he was named one of Time Magazine’s “Top 20 Environmental Heroes of the 20th Century.” In 2012, he became only the second person ever to be honored with the Jules Verne Award for environmentalists and adventurers. Captain Watson is a national treasure.
According to the procedures on the “We the People” White House Petitions page, Sea Shepherd has until close of business on February 28th (30 days) to garner 100,000 bonafide signatures from individuals 13 years and older who support these motions in order for the White House to consider taking action on the petitions.
Sea Shepherd has been engaging in interventions on the high seas in defense of marine wildlife for 35 years and for the last eight seasons against Japan’s Institute for Cetacean Research (ICR) — a front for illegal, government-subsidized whaling — all within the confines of the law and without causing serious injury. Launching of the petitions is the latest effort by the conservation group to fight the ICR’s efforts to kill whales in a designated sanctuary and persecute the group’s founder, Captain Paul Watson.
“The majority of citizens in the free world have demonstrated time and again they are against the killing of intelligent, sentient whales, particularly when it involves killing in an internationally designated sanctuary,” said Scott West, Director of Investigations for Sea Shepherd. “Now is the time for everyone who values majestic marine wildlife in our oceans to sign this petition and encourage the Obama Administration to act to protect these at-risk whales who should not have to be subjected to harassment and a cruel, painful death from grenade-tipped harpoons shot within the confines of a sanctuary,” he added.
The second petition, which focuses on the legal status of Sea Shepherd founder, Captain Watson, asks for him to be provided safe haven in the U.S. Captain Watson is currently at sea as an observer with this season’s current Antarctic Whale Defense Campaign, on the SSS Steve Irwin. He cannot make landfall due to being the target of two ‘red notices’ issued by Interpol put forth at the request of Costa Rica and Japan, which seek to extradite him to those nations for trial on trumped up, politically motivated charges related to defending marine wildlife from poachers.
“Captain Watson is an eco-hero doing the job of enforcing marine conservation law that governments have shown they lack the political will or economic means to do,” said Susan Hartland, Administrative Director, Sea Shepherd. “He has won countless awards including President George H.W. Bush’s ‘Daily Points of Light Award’ for his conservation work and should be on a list of national heroes, not on Interpol’s “Red List,” she said. “The charges against him are clearly politically motivated and we, as a society, should be asking why, instead of Captain Watson, are the illegal whale poachers and shark-finners not being targeted by authorities and put on Interpol’s ‘Red List’?,” she added.

Dear Friend of Sea Shepherd,

There's so much you can do to defend marine wildlife, no matter where you are in the world. Not everyone can join a Sea Shepherd campaign, and many people aren't able to financially support the conservation efforts so close to their hearts. In this edition of the Sea Shepherd E-News, we present many ways that you can make an impact for our mission and the animals at no cost to yourself.

If you are someone who is fortunate enough to be able to help finance our mission, please keep us in your heart. Your contributions are the very lifeblood that keeps our organization on top as the world's leading direct-action conservation non-profit. Each person in this world can do something to contribute to the greater good, whether it is a financial contribution and/or the contribution of your time and energy in person or even online. Have you thought about what you can do to help defend, conserve, and protect the oceans?
Save Whales and Help Captain Watson
The United States White House has created a modern and easy way for the people's voice to be heard. Official petitions can be created on their website, and once a petition receives 100,000 signatures it elicits an official response from the White House.
Sea Shepherd has created two very important petitions, one of which could provide safe haven for Captain Watson and the other asks the United States to take strong action to stop the Japanese from killing whales in the Southern Ocean Whale Sanctuary. We only have until February 28th to reach the required number of signatures.

You don't have to be a US citizen to sign the petitions, but you do need to create a user account on their website. Help us!

Secret Rooftops Hiding Shameful Atrocities
Can you guess what those light and dark grey things on the roof of the building pictured below are? Each speck represents a shark's fin! In fact, you are looking at more than 10,000 shark fins drying on a roof in Hong Kong during the month of January! Gary Stokes, Sea Shepherd Hong Kong Coordinator, broke the story, garnering worldwide news coverage.

Sharks need protection now, and they need CITES (the Convention on International Trade in Endangered Species) to do the right thing and base their protection status on scientific facts rather than financial greed. Only when the killing and trade of this apex predator, which is so vital to the health of the oceans, become officially illegal will we see a stop to this atrocity. Learn more!

What we do is not easy. Sea Shepherd works on the cutting edge of activism. We go where others dare not go and take on tasks that no one else has ever done, and we do it all within the boundaries of the law, and without causing harm to any sentient beings.

Yes, we push the envelope and we take chances, and we have been doing so for thirty-five years, but in that time we have achieved some amazing victories, yet there is still so much work to be done. We operate on a relatively small budget with a predominately volunteer crew, and we are able to do so much because of your generosity and compassion. Thank you for standing strong with Sea Shepherd. Your support inspires us to take action each and every day.
