Court: Chevron Can Seize Americans' Email Data 22JUL13

WITHOUT Edward Snowden's disclosures of the US government's on line spying program known as Prism we wouldn't be aware of the government's collusion with chevron, allowing the oil and gas giant accesses to the e mail accounts of Americans who oppose cheveron's agenda, especially those concerning the court cases against them involving the Ecuadorian rainforest tribes. It is extremely disturbing that a federal judge would actually allow an international corporation total access to the private e mail accounts of Americans, or anyone involved in supporting the Ecuadorian plaintiffs in their court cases against chevron, court cases the company continues to loose, and that the US Supreme Court has refused to hear, rejecting chevron's appeal. Court: Chevron Can Seize Americans' Email Data

In an almost unprecedented decision, a federal judge has allowed Chevron to subpoena Americans' private email data—and said the First Amendment doesn't apply.

Indigenous Ecuadorean leader Emergildo Criollo travels from the Amazon rainforest to California to deliver 325,000-plus letters urging Chevron to clean up its toxic oil.
Thanks to disclosures made by Edward Snowden, Americans have learned that their email records are not necessarily safe from the National Security Agency—but a new ruling shows that they're not safe from big oil companies, either.
Last month, a federal court granted Chevron access to nine years of email metadata—which includes names, time stamps, and detailed location data and login info, but not content—belonging to activists, lawyers, and journalists who criticized the company for drilling in Ecuador and leaving behind a trail of toxic sludge and leaky pipelines. Since 1993, when the litigation began, Chevron has lost multiple appeals and has been ordered to pay plaintiffs from native communities about $19 billion to cover the cost of environmental damage. Chevron alleges that it is the victim of a mass extortion conspiracy, which is why the company is asking Google, Yahoo, and Microsoft, which owns Hotmail, to cough up the email data. When Lewis Kaplan, a federal judge in New York, granted the Microsoft subpoena last month, he ruled it didn't violate the First Amendment because Americans weren't among the people targeted.
Now Mother Jones has learned that the targeted accounts do include Americans—a revelation that calls the validity of the subpoena into question. The First Amendment protects the right to speak anonymously, and in cases involving Americans, courts have often quashed subpoenas seeking to discover the identities and locations of anonymous internet users. Earlier this year, a different federal judge quashed Chevron's attempts to seize documents from Amazon Watch, one of the company's most vocal critics. That judge said the subpoena was a violation of the group's First Amendment rights. In this case, though, that same protection has not been extended to activists, journalists, and lawyers' email metadata.
The Electronic Frontier Foundation (EFF) represents 40 of the targeted users—some of whom are members of the legal teams who represented the plaintiffs—and Nate Cardozo, an attorney for EFF, says that of the three targeted Hotmail users, at least one is American. Cardozo says that of the Yahoo and Gmail users, "many" are American.
"It's appalling to me that the First Amendment has no bearing in this case, and that the judge simply assumed that all of the targets aren't US citizens—when in fact, I am," says a human rights activist from New York who has been advocating on behalf of the indigenous community, doing both volunteer and paid work, since 2005. He has never been sued by Chevron, nor been deposed. He wishes to remain anonymous—because his legal fight against the subpoena is still pending. The activist received a notice of the subpoena from Google last year (it has not been granted yet.) Chevron is seeking information including, but not limited to, the name associated with the account and where a user was every time he logged in—for the past nine years.
"Chevron is trying to crush, silence, and chill activism on behalf of the people they screwed over," the activist argues. Michelle Harrison, an attorney for EarthRights International, tells Mother Jones that her clients aren't comfortable going on record about the subpoenas they've received, because "Chevron's dogged pursuit of anyone that dares speak out against them is regrettably having precisely the chilling effect we warned the court it would."
Advocates for the plaintiffs in the Chevron case say that subpoenaing the email records is the company's latest nuclear tactic to win a lawsuit it keeps losing. Chevron was ordered to pay $9 billion in damages in 2011 and to issue a public apology. After the company refused, a judge ordered the damages to double. The Supreme Court has declined to hear Chevron's appeal. The extortion case is set to go to trial on October 15, after Kaplan—whom the Ecuadorean plaintiffs once asked to be removed from the case—refused to delay it.
Cardozo says there are 101 email addresses listed in the subpoenas to the three tech companies, but EFF has found only two that are owned by actual defendants in the lawsuit. "Subpoenas of nonparties are generally quite routine," says Eugene Volokh, a professor at the University of California-Los Angeles School of Law. But Karl Manheim, a professor at the Loyola School of Law in Los Angeles, notes, "The parties seeking the info have to establish its relevance to the case; you can't just go on a 'fishing expedition' or on a hunch."
Julian Sanchez, a research fellow at CATO, says that "even assuming the account holders aren't citizens, it doesn't automatically follow that the First Amendment is irrelevant." But he notes that while anonymous speech made by Americans is protected under the Constitution, "courts have been inconsistent in applying that protection against civil subpoenas aimed at identifying anonymous internet users." In the case Dendrite International, Inc. v. Doe No. 3, for example, an appellate court held that a company was not allowed to unmask users who had criticized the company on a Yahoo message board.
Manheim says the judge's invocation of citizenship is "wrong" in this case and the users should appeal. "The US Constitution applies to all persons (even foreign nationals) within US borders and to US persons abroad. While the targets of the subpoenas are outside of US jurisdiction, the subpoena itself is operative within the US. So the Constitution should apply." (Chevron did not respond to request for comment.)
"I think if the NSA scandal has taught us anything, anyone who says that 'it's just metadata' doesn't know what metadata is—if I want to spend the night at my friend's house and use his computer, that's my business," Cardozo says. "And if Judge Kaplan thinks seizing metadata is routine, he doesn't know how powerful it can be." The activist adds, "It's a slippery slope. Once one thing is granted, it will only be easier to ask for more."

Project Update #5: Foraging & Feasting: A Field Guide and Wild Food Cookbook by Dina Falconi and Wendy Hollender 1FEB13

HERE is another Kickstarter project I decided to support, this is the 6th project I have backed and the 5th to meet it's fundraising goal and so will receive the pledges from people like me. I am not rich, but I sure ain't poor, God has been good to me and so if I can lend a hand for a worthy cause or project I'll do it. This is an amazing time for us. Two days ago we were pleasantly surprised to learn that Kickstarter had chosen our book as “Project of The Day”. By the end of that day we had reached 85% of our goal ($20,000).
All of a sudden at 2 pm yesterday the pledges literally starting flying in: Ten orders every second! Either I called Dina or she called me, (who can remember, we were so flustered) and we watched our computer screens in astonishment, what could be happening? A few moments later we received a newsletter from Kickstarter. They were recommending three projects: ours was the first one! The day continued as a blur. We met our Kickstarter goal in the next twenty minutes and the pledges kept flowing like a stream after a major (but very loving) storm. 24 hours later we are over $52,000! Many people are emailing questions and suggestions and we are trying to respond to everyone.
Words cannot express the level of gratitude we are feeling right now. For three years we have been quietly working and preparing this book, often taking walks together at the end of a workday, fantasizing how we would make this project a reality. You have made it real.
P.S. We set our project goal of $25,000 as a partial contribution toward the actual cost of pre-production and printing. Please note that with more pledges we can produce an even better book, instructive visual products and perhaps an e-book.

Project Update #11: Rewards shipped forreallyreal, credit where credit is due, and progress 1FEB13

HERE is an update on one of the projects I backed on Kickstarter, Robotboat Mark VI....

Oh hai guuuuys.
We'll have all of the rewards shipped by tomorrow (except the postcards which will be done shortly after the maiden voyage).  If you still haven't gotten something drop me a line.  SHWEW.  We really hope everybody is enjoying the rewards.  We tried to make them special. For those of you who will have inscriptions on the boat, lookout for confirmation in the next few weeks followed by some pictures.
We've heard a lot of good feedback about the rewards, particularly the t-shirts, of which we are especially proud.  Much as we'd like to take credit for the design, the real maestro behind the shirts was my friend Forrest @ Studio One.  I've worked with them on a bunch of projects and I must say, it is always a pleasure.  In our estimation, the keychains came out pretty dang rad too, and in keeping with proper attribution I want to shout outJon @ Imprint Items.  Jon suffered my franticness and rushed to make sure we'd get them in time (despite a few rounds of misunderstandings).  The 3D printed models were made by Stewart @ CRP USA and they are boss.  They are made from the same material we've used all over the place on the Mk VI.  Windform XT is good enough for F1 cars, good enough for Robotboats & satellites (Walt's design btw), good enough for your bathtub.  Like magic.
So with the rewards all sent, we're gonna pack it in, cause this is just too hard and we already have your money...
PSYCH!  I assure you that we're working as hard as we can to push this technology.
The Mk VI is coming along.  We're continuing our tradition of employing top-notch U.S. manufacturers.  May we recommend Solid Concepts for your experimental watercraft needs?  FJB for your prototype weldments?  We've already received almost all of the small parts and some of the big complicated parts.  Below you can see a sweet mast solo and one of the custom made molds for the hulls.
We expect to be on the water in ~1 month (yes we are about a month behind schedule, sorry about that - really thought we were immune, but obviously should have known better, ehem).  We'll keep you posted throughout the assembly/calibration stages and during live trials.  As always dear backers, please don't hesitate to contact us with any questions or concerns.

MARIA from PLAYING FOR CHANGE

I know I just posted a request for funding of a great project on Kickstarter, Robotboat Mark VI (and they did make their funding goal in time so THANKS TO ALL WHO PLEDGED AND CONTRIBUTED!!!!!), but I gotta post this Kickstarter project for Playing For Change because the whole organization is so cool and they do a lot of good and produce great music too! "Maria" was recorded and filmed in his back yard in South Africa. Sometimes great music is just in the moment, and today we celebrate these moments together through music.

Hello everyone, we are “Playing For Change”.
A Global music project that began with a dream to connect the world through music and has evolved into a movement uniting people everywhere. (www.playingforchange.com).
Now there is an opportunity for the millions of people who have been touched by the Playing for Change artists and family around the globe to be personally involved with our most exciting project ever…the Playing For Change 3 (PFC3) album and DVD/blue ray to be launched globally in 2013, in association with concerts around the world.

The project came to life about 8 years ago when I was walking on the streets in Santa Monica, California, and I heard the voice of Roger Ridley singing, “Stand By Me”.  He had so much soul in his voice and I approached him and I said if I come back with some recording equipment and cameras we would love to record and film you playing “Stand By me” and take the song around the world adding different musicians to the track.  He looked at me like I was crazy but he said if you come back, I’ll play the song. When the crew and I returned, Roger was in a set break and I asked him, “with a voice like yours why are you singing in the street?  He said, Man: I’m in the Joy business, I just like to come outside and be with the people.” Ever since that day Playing For Change has been traveling across the globe building a family and creating songs around the world.
PFC 1 was our first CD/DVD featuring “Stand By Me” and “One Love”, two global anthems that helped launch PFC into the hearts and minds of people everywhere.
As our music and message spread across the world PFC 2 was born, our second CD/DVD featuring ten new songs and stunning videos of our artists playing on the street in different corners of the world.  We kicked off in West Africa featuring “Gimme Shelter” and “Redemption Song” as well as new original songs around the world such as “Satchita” and “Music is my Ammunition”.
PFC 3 is our new project and we are relying on your participation and all our energies to create something truely amazing.  The CD and DVD/Blue Ray will feature ten new songs and videos around the world.  Our community of supporters is allowing us to be fully independent and we are looking to the people of the planet to help us create a masterpiece together.  Music legends such as Keith Richards, Los Lobos, Keb’ Mo’ and of course, Grandpa Elliott will all be participating on the new album. Join us on a musical journey as we travel from the Congo to the Mississippi, Australia, Europe, Jamaica, Cuba, Mexico and South America. 
This project has always been from the people, for the people.  The Internet helps us directly reach the hearts and minds of people everywhere. Now we can directly invite all of you to participate in the process of creating and launching PFC 3. Please help us by supporting our new PFC 3 CD/DVD and together we will leave this world better than we found it.

A small crew of people travel the world overcoming the obstacles of cultural differences and using the connective power of music to bring us together. Playing For Change represents the Humanity in all of us and therefore it succeeds in uniting people who otherwise might not find positive ways to connect. We also treat everyone with love and respect and simply invite them to participate with no expectations or requirements. The risks of traveling to far off places in the world are simply treated as an adventure for the sake of music and humanity. Music is our ammunition.

Robotboat Mark VI (A KICKSTARTER CROWDFUNDING PROJECT) DEADLINE 12OKT12 UPDATE 9OKT12

JUST AN UPDATE ON THIS PROJECT, they now have $70074.00 in pledges since I first posted this on 7OKT, just $9026.00 away from meeting their goal of $80000.00 by 2PM / 1400 Friday 12OKT12. They have to meet that goal or they get nothing. WAY TO GO EVERYONE WHO HAS PLEDGED!!! If you didn't, will ya consider it? If you can't will you pass this on to others who might? Think about it!!!!
THIS is another project on KickStarter I decided to back because it is way cool, it will be good for the American economy and very good for the world's oceans. There are an awful lot of really talented, passionate, and capable people working on trying to figure out how we can better understand and be better stewards of our agua.  One of the happiest surprises of the campaign so far has been connecting with some of them.  It's a good thing too, because there is not a lot of time to waste.  As we round out the 20th day of our campaign, we are proud to be able to say that we've made it just about halfway to our financial goal.  We are also very proud that so many people have thought this cause worthy of their time and precious resources (nearly 1000 backers!).  We are especially proud of the people who have waded out into the new and exciting world of crowdfunding for the first time to support Robotboat.  At the risk of being pedantic (you seasoned backers will have to bear with us), we thought it prudent to point out an important feature of this effort, and indeed all Kickstarter campaigns: if we fall short of our goal, by even one dollar, it will all be for naught. Kickstarter is all-or-nothing in that regard.  We feel as though this project is both important and urgent in the context of global water stewardship.  And, through the looking glass, your support has become both important and urgent to the project.  We have only ten days left and quite a few dollars to go.  If you haven't already (we are thrilled and humbled by the fact that so many of you have) would you consider sending a note/link to your friends, co-workers, relatives, neighbors, respected enemies, and anyone else you think might care or be in a position to help?  Together we can make the dream of abundant, accurate, ocean data an irrefutable reality.

We're building a fleet of autonomous sailing robots to study the oceans. Each boat can sail itself anywhere & send data back to shore.

WHAT IS THIS ANYWAY?

We're asking for your help to produce and test the ROBOTBOAT MARK VI.  Each robotboat is fully autonomous, needs no fuel, and will bring to bear myriad sensors at remote points on the surface of oceans, lakes, and rivers.  Think of it as a satellite for the seas.

WHY?

We need lots of low-cost self-propelled robots to study the health of the world's water.  Never send a person to do a buoy's job!  The real value of this technology lies at the fleet level, but given the extremely high performance required of each boat, purchasing even a few of them is simply beyond our means.  Building one boat represents a huge step towards cheap data.  Building more than one boat will allow us to test swarming algorithms, implement complex communication schemes, and take greater risks (e.g. undertake longer, more challenging missions).
Bringing this opportunity to the kickstarter community will allow us to develop this technology MUCH FASTER than we could if we have to fund it ourselves;  the more resources we can raise here, the faster we can deliver.

WHY SHOULD I CARE?

Perhaps Lilly Tomlin said it best: "I said 'Somebody should do something about that.'  Then I realized I am somebody."
No matter where you stand on issues like climate change, marine conservation, offshore energy production etc., we hope you'll agree that everyone is better served by policies and behavior based on empirical scientific evidence.  We should all care about how we manage our water resources.
We think Robotboat is the best way yet to generate information about the world's oceans.

WHO ARE YOU?

Walt, Rob, TJ, and Eamon... Hi.
We're a professional engineering team.  Between us we hold 8 patents and have over fifty years of engineering experience.
Our principals (Walt & Rob respectively) founded these companies:
Planetary Systems Corp. and Tiger Innovations
TJ and Eamon have worked for Walt making satellite subsystems for the last few years (among other pursuits).  We've designed and executed dozens of successful missions.  We've produced space flight hardware, ground station equipment, and remote sensing systems for the most demanding customers in the world,  Collectively, our expertise is in developing robust mechatronics.

HOW ARE YOU GOING TO PULL THIS OFF?

We've built & tested 5 autonomous sailing robots over the last several years.
Our boats have completed hundreds of hours of fully autonomous navigation and traversed hundreds of kilometers on the water.
We've proved a robust sailing algorithm.  In the GPS trace below you can see the boat complete upwind tacking maneuvers without human control.
We've completed the Robotboat Mark VI design.  We're going to build it like a surfboard; it will be incredibly strong and be capable of being rolled in waves indefinitely.
We won't quit.
Neither will the boats.  The Robotboat Mark VI features a patent pending self-righting mechanism, the first and only such system in existence.  It can prosecute targets day or night, rain or shine, wind or doldrums, thanks to its advanced wing sail and assistive electric propulsion system.
And... we'll need your help.  R&D of this nature is not cheap.

Hello, this is John, bass player and bandleader for MarchFourth. I am on every tour, so I feel intimately connected to our bus. Every time we go on the road I pray that we make it home safely and don’t miss any shows. It’s a small miracle that even though the bus broke down a few times last year, we managed to make every date (we were a couple hours late for the Strawberry Music Festival, but they found room for us to play anyway and we arrived to streets lined with cheering festival-goers). Our 9th Anniversary shows this past weekend marked the end of our busiest year to date, and the band is finally taking a much-deserved break to develop new material before we hit the road again in late April (see all the new dates below). We will also use this break to buy a new bus and start the process of customizing it to our needs. Thus, the Kickstarter campaign.
Last night I wrote a little piece to send out this morning as a last-minute promotional push. I awoke today to discover that we’d already reached our goal! Razzle Dazzle 2.0 -- The MarchFourth Bus Project

I have been a backer of a couple of projects on Kickstarter, Razzle Dazzle 2.0 benefiting March Fourth Marching Band is my latest. I saw them in the Spring of 2008 and it is still one of the best shows I have even been to. They don't come to the East Coast often enough, so I envy you guys on the West Coast and in the Rockies where your chances at a March Fourth concert are much better. Check out the first video below for just a taste of what the band is all about and then I do hope you will check out their Kickstarter fundraising page (see below or click the link to go to their fundraiser page) for their much needed new bus and will become a backer if you can.....and will share this with others who might become backers....

The MarchFourth Bus Project

Your favorite intergalactic marching band, MarchFourth, needs a new space ship! Our beloved bus, Razzle Dazzle, is getting old and she ain't what she used to be. Razzle's not very gas efficient and spews more exhaust than we'd like to admit... and she broke down three times last year! (though amazingly we never missed a gig =) Without a reliable ride, we can't get to your town to rock your face off.
We've got our eye on Razzle 2.0, but it won't come cheap. We need YOUR love and support. We want nothing more than to continue zig-zagging around this beautiful continent, leaving a wake of biodegradable glitter and joy, for years to come. Wouldn't you like that too?
