HARRISBURG, Pa. — A state court judge on Friday struck down a Pennsylvania law requiring that voters to show photo identification at the polls.
Judge Bernard L. McGinley of Commonwealth Court said the requirement, which was the centerpiece of Pennsylvania’s 2012 voter identification law, placed an unreasonable burden people trying to exercise their fundamental right to vote.
The decision is likely to be appealed to the Pennsylvania Supreme Court. Republicans approved the law over the protests of Democrats.
During a 12-day trial last summer, challengers to the law said that hundreds of thousands of voters lacked acceptable identification and argued that the inconvenience of getting it might discourage some from voting. State officials insisted there were ample opportunities for voters to get valid identification.
The court has barred enforcement of the law since the 2012 general election.

Ruling that "voting laws are designed to assure a free and fair election" and that Pennsylvania's "Voter ID Law does not further this goal," a state judge on Friday struck down that controversial statute.

The Associated Press writes that:
"McGinley said the requirement that was the centerpiece of Pennsylvania's embattled 2012 voter identification law places an unreasonable burden on the fundamental right to vote.
"The decision paves the way for an expected appeal to the Pennsylvania Supreme Court. Republicans approved the law over the protests of Democrats.
"During a 12-day trial this summer, plaintiffs said hundreds of thousands of voters lacked acceptable IDs and the inconvenience of getting a photo ID might discourage some from voting. State officials insisted there were ample opportunities for voters to get a valid ID if they had none.
"The court has barred enforcement of the law since [shortly before] the 2012 general election."
In his opinion, McGinley writes that the law presents a "substantial threat" to the rights of "hundreds of thousands" of potential voters.
, the law would require voters "to show a particular state-issued photo ID before casting ballots. ... Supporters say photo ID is a common-sense requirement that keeps people from impersonating someone else and casting a fraudulent ballot. Opponents say it's an attempt to disenfranchise minorities and Democratic-leaning groups, who are less likely to have photo identification."
The legal challenge, as NPR reported, was "filed by the American Civil Liberties Union with 93-year-old Viviette Applewhite as the lead plaintiff. She's a longtime voter, born in Philadelphia, who wouldn't be able to get the ID she would need under new rules because she doesn't have a birth certificate or other key identifying documents, such as a non-driving license."

REMEMBER this video of Pennsylvania repiglican / tea-bagger speaker of the house mike turzai speaking about the real reason why the PA Assembly passed the Commonwealth's repressive voter ID law? Here it is just to refresh your memory, watch it, and imagine the look on his face when that smirk was slapped off by a PA judge today. A judge in Pennsylvania narrowly blocked the part of the state’s voter ID law that would have required voters to present a photo ID within six days of election day.
From the Philadelphia Inquirer:
“Simpson decided that the law does not disenfranchise voters simply because it requires poll workers to ask for photo ID. Rather, the risk comes when a voter casts a provisional ballot but then cannot obtain the necessary identification in time.
As a result, Simpson decided that for the November 6 election only, voters without appropriate photo ID could vote, but would no longer have to produce identification within six days, as their votes would be counted.”
The narrow ruling will likely be appealed.
“We are very glad voters will not be turned away from the polls this November if they do not have an ID,” said Judith Browne Dianis, Co-Director of the Advancement Project, which sued to block the law. “The evidence made it clear to the judge that this law would indeed disenfranchise voters and that the Commonwealth was not equipped to implement it fairly right now.”

A judge is basically "postponing Pennsylvania's tough new voter identification requirement, ordering that it not be enforced in the presidential election," The Associated Press writes.
But in a ruling that's rather difficult to follow if you're not very familiar with the case, Commonwealth Court Judge Robert Simpson also says he "will not restrain election officials from asking for photo ID at the polls; rather, I will enjoin enforcement of those parts of Act 18 which directly result in disenfranchisement."
Simpson ruled that a voter's "provisional ballot" cannot be declared invalid because of the lack of an ID and that the state's transitional effort to amend its laws regarding such votes must not take effect before Election Day — Nov. 6.
So, it appears from his ruling, election officials can ask for an ID. But a voter's lack of one will not invalidate his vote.
The ruling can be appealed to the state's Supreme Court.
As the AP wrote before the ruling was released:
"Pennsylvania's new law, among the toughest in the nation, is a signature accomplishment of Republicans in control of Pennsylvania state government who say they fear election fraud. But it is an emotional target for Democrats who call it a Jim Crow-style scheme to make it harder for their party's traditional voters, including young adults and minorities, who might not carry the right kind of ID or know about the law."
Update at 10:20 a.m. ET. Bottom Line Is "Pennsylvanians will not be required to show ID to vote this year."
Harrisburg's The Patriot-News sums up the story this way:
"Commonwealth Court Judge Robert Simpson has ruled that Pennsylvanians will not be required to show ID to vote this year. Simpson is postponing Pennsylvania's tough new voter identification requirement, ordering that it not be enforced in the presidential election. ...
"The ruling means people will be asked to show ID but will be allowed to vote even if they don't. That was also the policy in effect for the primary this year."
The Pittsburgh Post-Gazette explains Simpon's ruling this way:
"The injunction would have the effect of extending the transition period of the law — when voters were asked for identification but could vote without it — through the November election."

The Pennsylvania Supreme Court's ruling on voter ID is...18SEP12

THANK GOD there are still some institutions in Pennsylvania that seem to be beyond the control of the repiglican / tea-bagger government of the Commonwealth. The PA Supreme Court ruling will force the lower court to certify the PA Dept of Transportation will be able to issue approximately 750000 voter I.D.s in time for the election. Everyone knows this is not possible and so the law, baring a ruling by the lower court that defies the PA Supreme Court, has been nullified. It is a great day for democracy in Pennsylvania!!!! Craig, in a major decision that could lead to Pennsylvania's harsh voter ID law being overturned, the Pennsylvania Supreme Court has vacated the ruling of a lower court which upheld the law.

The Supreme Court has now given the lower court two weeks to determine if the Pennsylvania Department of Transportation can provide reasonable access to photo IDs for residents who currently lack them. If the court finds that the Department of Transportation is unable to do this in time for the upcoming election, then the law will be overturned.

Given that the number of people who currently lack photo IDs in Pennsylvania is estimated to be around 750,000, there is a good chance that providing reasonable access to new IDs will prove to be impossible, and thus the voter ID law will not be in effect this November.

This is good news, and not just because it nearly puts Pennsylvania out of reach for Mitt Romney. Two of the most important House races in the country are in Pennsylvania's 6th and 8th congressional districts, where solid progressives Manan Trivedi and Kathryn Boockvar are taking on Republican incumbents. With this ruling, both Trivedi's and Boockvar's efforts to get Democratic voters to the polls just got a huge boost, and that gives us all a much better chance of taking back the House of Representatives from the tea party.

PENNSYLVANIA has the most restrictive voter I.D. law in the country, something the Commonwealth should be almost as ashamed of as the Penn State-jerry sandusky child abuse scandal. It is estimated that over 758,000 voters will be denied the right to vote in this years election if the law stands. Thankfully the ACLU is challenging this law in court and the Justice Dept has launched an investigation. Wonder why this law was passed when Pennsylvania legislators admit they have no knowledge of in person voter fraud in the state or even in the country?
