THIS legislation is long overdue. American corporations feel not obligation, no responsibility to the nation and the taxpayers who have funded their growth and development. Now is the time to put a stop to their abuse of the corporate welfare system, if they are going to create jobs in the prc, India and other developing countries let those countries fund their R&D. Time to Stop Giving Away Taxpayer-Funded Technologies to China

This week, I introduced legislation to stop technologies developed with the support of U.S. taxpayers from being given away to China or other countries. Many American companies operating in China are required to transfer their intellectual property and proprietary technology to China as a prerequisite for doing business there.  Many of these technologies were developed using U.S. tax dollars through grants, loans, loan guarantees and other federal incentives in order to make America competitive and create American jobs.

If taxpayers supported the development of the technology, they own a piece of it and it can’t just be given away. Federal dollars that go toward R&D funding, loan guarantees, and public-private partnerships in order to help develop the next generation of technologies here are supposed to be making American businesses competitive and generate American jobs—not to help develop other industries, such as those in China.

In cases where technologies are developed with the support of the American taxpayer, my legislation prohibits companies from transferring the technology to countries that by law, practice, or policy require proprietary technology transfers as a matter of doing business. The transfer of publicly supported proprietary technologies by American firms to China -- and potentially other countries -- clearly and unequivocally places the competitive advantage of the American economy at risk.

Examples of China profiting from U.S. taxpayer-funded technologies:

    • General Electric has transferred valuable aviation avionics technology to state-owned Aviation Industry Corporation of China.  The U.S. government has long supported the aviation industry through procurement initiatives and federal research projects.  The fruits of U.S. taxpayer support will now be incorporated into Chinese commercial airliners, in line with Beijing’s desire to develop an internationally competitive aircraft industry that could rival U.S.-based Boeing.  (Source: The Washington Post)

    • Westinghouse Electric has transferred more than 75,000 documents to Chinese counterparts as the initial phase of a technology transfer agreement in exchange for a share in China’s growing nuclear market. These documents relate to the construction of four third-generation AP1000 reactors that Westinghouse is building in China.  U.S. taxpayers supported the development of the AP1000 as well its predecessor, the AP600, through decades of nuclear energy research and development at the Department of Energy (DOE).  Moreover, the DOE Nuclear Power 2010 program provided years of government support for the design and licensing of this reactor.     • Ford Motor Company is looking to share certain proprietary technologies for electric vehicles in exchange for selling cars in China.  The electric vehicle sector has enjoyed significant federal R&D funding, loan guarantees, and public-private partnerships funded by U.S. taxpayers.  In 2009, Ford Motor Co. received a $5.9 billion loan guarantee from the Department of Energy to advance its vehicle technology manufacturing program. A U.S. Chamber of Commerce report warns that China’s “persistent” intellectual property theft is “compounded by the indigenous innovation industrial policies which compel technology transfers in order to have access to the China market.”

In a January 2010 letter to Obama Administration officials, the heads of 19 U.S. business and industry associations—including the Business Roundtable, the National Association of Manufacturers, and the Chamber of Commerce—wrote of “[s]ystematic efforts by China to develop policies that build their domestic enterprises at the expense of U.S. firms and U.S. intellectual property.”

The Oil Spill & Missed Opportunities, So What Now Congress? from SOJO

HERE is a call to action from Sojourners on the failure of the Senate to pass clean energy and climate change legislation. A massive oil spill in the Gulf of Mexico and a devastating, massive oil spill in China – you would think the world’s two largest polluters, and U.S. legislators, would be getting the message: It’s time to move beyond dirty fossil fuels.

Thanks to your support, Sojourners’ members made this statement loud and clear last week – sending more than 17,000 letters to Congress asking for investment in new, clean energy sources; smart regulation of pollution (like carbon); and aid for and accountability to the Gulf.

Seems like they only heard half of our message.

Early this week, Senate majority Leader Harry Reid announced he would schedule a vote on a bill that would provide for some helpful and needed support in the Gulf region (such as expanding BP’s liability cap, fixing the regulatory system for oil and gas drilling, and investing in conservation), and would even support some small investments in a new energy economy (like incentives for green home building). 

Missing in this legislation? A clear commitment to move our country away from fossil-fuel dependency, to fight climate change, and to set a renewable energy standard. Send a message to your senators, click here

The reasons for the anemic, short-sighted bill should cause us concern: lack of political will – fueled by election-year politicking – and lack of courage to take the tough votes that will be opposed by the oil and gas industry.

This oil spill was a giant wake-up call to our nation, but it seems our leaders are still asleep. So while Congress takes the easy way out in the short term, we’ll all continue to face the long-term consequences.

MY LETTER TO SENS WARNER AND WEBB, BOTH DEMOCRATS FROM VIRGINIA
As a person of faith called to be a steward of God's creation, I am very disappointed that the Senate failed to pass comprehensive energy and climate legislation before leaving for vacation.

The oil spill is a huge wake-up call, and we need to listen. I want to know: What is your plan for changing our nation's energy future? What is your commitment to clean energy and fighting climate change?

What now?

I am not pleased to hear that there was a lack of support for taking the tough votes that will place our nation on the path to a new energy and environmental future. I am not happy with the $35 billion tax break you approved for the oil companies, especially knowing you Sen. Warner have received $25,650 and you Sen. Webb have received $81,650 in contributions from these companies. It certainly seems your votes on this issue can be bought, and your allowing nothing to be done on clean energy and climate legislation seems to indicate who had the winning bid for your votes and it wasn't the people of Virginia or the nation.

Passing Gulf oil spill-related legislation is a band-aid - we must address the root causes of this crisis.

Please respond at your earliest convenience with your plans to address the energy and pollution crisis in our nation, including how you will use your position to gain support from other senators for comprehensive legislation.

HERE'S my letter to Sens Webb and Warner.....I hope you will contact your Senators and tell them to get this legislation passed! And sign the petition below to end the tax breaks to the big oil companies.

As one of your constituents, I urge you to pass comprehensive energy and climate legislation before the August recess.  I also want you to ensure that this legislation includes a cap on carbon pollution and invests in clean energy that's made in America. We have the resources and the masses of unemployed to be retrained for jobs developing and sustaining and maintaining a new energy economy in this country. The power grid needs to be rebuilt with the same vigor the Interstate Highway system was built. Solar and wind power deserves the same level of financial support the dirty energy companies have received in the past. We should be able to develop a mass transit industry here supplying communities with subway cars, passenger rail cars and trams and should be supporting mass transit in urban areas and developing high speed passenger rail service. All of this will help end our dependence on coal and oil while addressing the massive unemployment problem we are facing. This national call to action can begin with this clean energy legislation that must be passed. must not be held hostage by the politicians, mostly from the Republican party who are controlled by their corporate masters from the big oil and gas and coal companies.

Oil companies and their corporate lobbyists have fought energy reform for decades to protect their profits  and in the process, they have made America more dependent on oil  -- hurting our economy, threatening our national security, and harming our environment.   I urge you to stand up to corporate polluters and stand with the American people by supporting action on clean energy and climate legislation now.
