Spanberger formally intervenes in proposed NextEra-Dominion merger

I formally intervened in the proposed merger between NextEra and Dominion because Virginians deserve to know that their long-term interests, not simply those of the companies involved, are being put first.


 UPDATE on the proposed Dominion Energy-NextEra merger which will have a negative impact for residential, educational and small business electric utility customers in Virginia and North Carolina and other parts of the Mid-Atlantic power grid. There was opposition to this merger as soon as it was announced and opposition has grown in numbers and strength to the point that these companies have found it necessary to sweeten the incentives described as "customer" benefits to gain support for approval of the merger by the Virginia SCC / State Corporation Commission. It will not work. Virginians have good reason not to trust anyone associated with either company since SCC chairperson kelsey bagot refuses to recuse herself from the case on this merger though she promised the general assembly in Richmond she would recuse herself since she had worked for NextEra. Dominion-NextEra merger faces calls to slow down after new customer benefits unveiled

RICHMOND, Va. — The Dominion Energy and NextEra merger is facing renewed scrutiny after the companies unveiled an expanded package of benefits for Virginia customers and employees — but at least one energy advocacy group says the new commitments are arriving too late in the process.

Clean Virginia, which has opposed the merger since it was announced in May, is calling on the State Corporation Commission to extend its review after Dominion and NextEra announced the updated deal Monday. The new package includes commitments to double bill credits, expand job protections, and build a new tower for NextEra employees, funded by NextEra shareholders.

Clean Virginia President Brennan Gilmore said the additions raise more questions than they answer.

"Months into this process, weeks into the official litigation process, now Dominion and NextEra are coming in with a whole lot of other baubles and Christmas tree ornaments to hang on to this deal. That makes it even more important that we reset the clock, we extend the clock," Gilmore said.

Intervenors have spent weeks preparing for the Nov. 17 evidentiary hearing. Gilmore is calling on Gov. Abigail Spanberger to convene a special session so legislators can push back the current January deadline.

"We need an extension of this timeline. We need to slow this process down to make sure that Virginia customers who are being charged some of the most incredible bills, certainly of my lifetime, they need to be protected," Gilmore said.

Dominion Energy Virginia President Ed Baine backed the potential merger saying it is designed to benefit the state.

"I don't have any hesitation around the merger. I believe it'll be good for our customers, good for our colleagues, good for the communities we serve, and good for the Commonwealth overall," Baine said.

Baine acknowledged the review process is still generating significant questions.

"The timeline is still a six-month timeline from a commission approval. Right now, there's a lot of questions being asked by the various parties," Baine said.

The SCC's deadline remains in January. If the commission does not issue a decision by that date, approval of the merger would automatically be granted.

I reached out to the State Corporation Commission to ask whether the announcement of new customer benefits could affect how commissioners review the merger.

Spokesperson Greg Weatherford responded saying this is normal for court procedures including at the SCC.

"All proposals and filings will be thoroughly reviewed and cross-examined by participating parties during the hearing. In the end, after the courtroom evidentiary hearing and public witness statements have concluded, the Commission will make its decision by applying the law, based exclusively on the evidence presented formally and cross-examined publicly, under oath, as part of the court process," Weatherford said.

RAINBOWS IN ASHBURN, VA 19NOV16

I love rainbows, and these were really beautiful. As usual the pictures don't do them justice, the colors were so bright and vibrant! It was sunny and warm here (Ashburn, VA) this morning, then a front moved through, really windy and sleet / hail, 27 mph gust, and it is now 42F / 38F wind chill. But we were treated to a beautiful double rainbow!

We just drove both Courtland Drive which has two lanes that are blacktop and Navajo which has a 12’ lane that is blacktop and very passable from end to end. As you know we are not plowing curb to curb. Thanks,

Hi Mr. Shannon,

I have been calling and e mailing about these two roads which are still snow covered and unable to handle school busses. Due to this, students are waiting for busses on Russell Branch Parkway which, as you know, is a busy road.

I was just told that snow removal operations have ended.  If school busses cannot travel on a road, it seems like additional plowing is still needed. I appreciate your thoughts on this and snow plows getting to these neighborhoods.   Thanks so much.

PRETENDING TO SERVE ASHBURN, VA AND NOT PLOW SNOW (CONTINUED) 1FEB16


I met Ron Meyer, the Loudoun County supervisor who is supposed to represent the area of Ashburn, VA I live in and Rep Barbara Comstock r VA, my representative in the U.S. House and her aid Maryann Cannon. I expressed my frustration with the lack of VDOT plowing Courtland Drive, sections of this heavily traveled road are still 1 lane. They asked me to e mail their offices about it, I did, and the road still isn't plowed. The e mails between me, Ron Meyer, his aid Judy McCary and Maryann Cannon ( and I did e mail Rep Comstock the same using her e mail form on her website) below.
Regarding my phone call to the Ashburn HOA. The first person on the phone was a worthless office drone, the director of the HOA explains the first person I spoke to. They said flat out even there are piles of snow at the entrances to my street so it is narrower than it should be they have no intention of plowing them back they are waiting for the snow to melt. I was also told townhouse owners pay $14.00 of their yearly HOA fees for snow plowing so basically they feel we got our money's worth with the one pass of the plow on my street last Tuesday afternoon. My response was that maybe there would be more money for snow plowing if the HOA office staff weren't overpaid groundskeepers. Like I said in earlier post, they can flit around Ashburn telling people what color they can paint their doors and trim and if their garden is too close to the common areas but when the residents really need their service it's BOHICA (Bend Over, Here It Comes Again)!

Hello,
I met you at the chili and beer fundraiser for the AVFRD at Old Ox in Ashburn. This is just confirmation of our discussion of the lack of action by VDOT regarding snow removal during the storm last week. I saw a plow on Courtland in Ashburn approximately 1730 / 5:30 PM Friday, 22 JAN 16 and we didn't see a plow again on Courtland again until Tuesday, 26 JAN 16. Courtland in Ashburn is still basically one lane from Ashburn Road to Ashburn Village Blvd. Because Courtland was not plowed in a timely manner the Ashburn HOA had an excuse, thanks to VDOT, for not plowing any of the streets off Courtland they are responsible for. It is up to the residents of Ashburn to deal with the HOA about their lack response to the storm. I, along with my neighbors on Afton Terrace, Crew and Falmouth, would appreciate it if the issue with VDOT and Courtland is addressed right away.

I just spoke to the director of Ashburn HOA about their lack of response and she mentioned that Courtland still hasn't been plowed and I told her I was working with your office to get that taken care of and her response was "good luck with that " because she said they have been working with your office for days on this. Maybe someone needs to go to the VDOT office and get in someone's face to get this taken care of since phone calls and emails aren't working. Hearing this from the HOA office is not a good reflection on your office. We would all appreciate more forceful action by you to get this problem resolved and to make sure it is never a problem in the future.
